JUSTICE IN THE SOUTH-EAST MEDITERRANEAN REGION
 
Release of a new report by the EMHRN, Copenhagen, 23.2.2005
 
The Euro-Mediterranean Human Rights Network (EMHRN) publishes a new report on the Justice in the South-East Mediterranean Region.
This report reviews the organisation of the Judiciary in the South-East Mediterranean Region[1], in analysing the civil, administrative, constitutional and exceptional jurisdictions functioning. It draws up an evaluation of the incorporation of the international standards into the legal systems of the countries concerned and their progress towards formal, institutional development of the rule of law and democracy. The report is based on the evolution of the case law in these countries and then represents a real information source for the civil society.
The aim of the report has been to initiate a regional debate on the Judiciary, to inform, to strengthen and support the dialogue between civil society and the European Union and the Euro-Mediterranean Partnership. Therefore, it presents recommendations and makes suggestions to promote the Justice in accordance with legal international standards.
The main findings of the report are that despite real – and often overlooked – progress towards modernisation - the political and judicial levels of power in the South and East Mediterranean remain intimately interlinked. The judiciary supports regimes in impeding development of democracy which results in insufficient guarantees for fair trial process and widespread recourse to exceptional courts.
This research has been accomplished by Ms. Sian Lewis Anthony (Human Rights Lawyer and a consultant) and by M. Mohammed Mouaqit (Professor at the University Hassan II Casablanca), in collaboration with more than one hundred representatives of the civil society in the Euro-Mediterranean countries. This report addresses the most important aspects of human rights in the South and East Mediterranean region: the issue of the legal system and people’s access to an independent, impartial, and fair system of justice.
